]]> MIAMI— Andres Rivero, Maria Paula Aguila, and Ana Malavé have successfully defended an international arbitration award they obtained against an appeal in the Eleventh Circuit Court of Appeals challenging the award’s confirmation.

Rivero Mestre first obtained an order confirming the arbitration award under the Inter-American Convention on International Commercial Arbitration in the action styled Productos Roche S.A. v. Iutum Services Corp., No. 20-20059-Civ-SCOLA (S.D. Fla. 2020) in the United States Court for the Southern District of Florida. The arbitral award was issued in Caracas, Venezuela, under Venezuelan law, against a Florida resident and a now dissolved Florida entity.

The Eleventh Circuit Court of Appeals affirmed the district court’s order confirming the award, holding that none of the exceptions to confirmation under the Convention applied.
