LIMA—Rivero Mestre co-sponsored an event at the Swissotel Lima in Peru on March 16. Jorge A. Mestre moderated a panel in which Amanda M. McGovern and Victor A. Mayorga spoke about the legal framework for application of forum non conveniens and the use of 28 U.S.C. § 1782 to obtain discovery in aid of foreign proceedings. CMS Hasche Sigle co-sponsored the event and participated by speaking about international arbitration. A cocktail party followed the presentation.

MIAMI — Rivero Mestre has successfully defended Serafín García Armas against Venezuela’s Banco Nacional de Crédito, C.A. Banco Universal (BNC) in Miami-Dade County Circuit Court for more than 15 million Bolivars. On May 5, the Circuit Court granted García’s renewed motion to dismiss based on the doctrine of forum non conveniens, finding that the appropriate forum for the action is Caracas, Venezuela, not Miami, Fla.

García’s renewed motion to dismiss was presented to the Circuit Court after the Florida Third District Court of Appeal reversed and remanded the trial court’s order denying García’s original forum non arguments.

Andrés Rivero and M. Paula Aguila represented García. The plaintiff first filed suit in Caracas, Venezuela, and then simultaneously sued in Miami-Dade County, dismissing its Venezuela action only after the Circuit Court abated the Florida action.
