MIAMI—Rivero Mestre proudly announces that the firm has been recognized by Chambers & Partners (Chambers) in the 2019 edition of Chambers USA as a top-ranked Florida firm for General Commercial Litigation. Chambers also recognized partners Andrés Rivero, Jorge A. Mestre, and Amanda McGovern for General Commercial Litigation.

Regarding the firm, one client emphatically states, “They’re excellent, everything you would want; a small boutique firm with excellent written advocacy. They also have a tremendous reputation with the judges and clearly have a great relationship with the courts. They’re phenomenal.”

Chambers describes Andrés Rivero as highly respected for his commercial litigation practice with one source noting he is “one of the more outstanding litigators in South Florida.” Representing a host of international clients in complex cross-border litigation across various sectors—from banking and finance to energy and healthcare—Jorge A. Mestre enjoys a “tremendous reputation with the courts” for his advocacy, according to market peers. Amanda McGovern offers impressive expertise in international litigation and arbitration, especially in matters relating to Latin America with one source praising her calm approach: “She doesn’t get rattled at all. She’s a very effective advocate.”

Chambers USA annually ranks the work of leading U.S.-based law firms and their attorneys in different practice areas. Selection to these rankings are based on a thorough “assessment of a firm’s work and opinions from external market sources, with an emphasis on client feedback” that demonstrates “sustained excellence.”

MIAMI—The Daily Business Review reported on Rivero Mestre’s recent victory in the Florida Third District Court of Appeal, which overturned a trial court order denying a motion to dismiss based on a forum selection clause in the parties’ agreement. M. Paula Aguila successfully argued that the forum selection clause was clear as to where the case—Hamed Wardak, et. al. v. Estrategia Investimentos, S.A., et. al.—should be heard. Aguila, Andrés Rivero, and Alan H. Rolnick are defending a Florida resident and several Florida entities, against claims in Miami-Dade County Circuit Court, arising from a multimillion dollar financial transaction.

The Court of Appeal sided with Aguila’s argument stating that, “the plain language of this contract expresses an unmistakable intent to make the forum provision exclusive…[and that] there was no ambiguity.”  The Court of Appeal concluded that the forum selection clause, as written, was mandatory, exclusive and unambiguous and, thus, the case should be litigated in Brazil. The Third District Court of Appeal reversed the trial court order on October 17, 2018.
