MIAMI—The Daily Business Review reported on Rivero Mestre’s $126 million-dollar settlement with Blue Cross and Blue Shield of Florida Inc., which has agreed to cover a life-saving treatment for hepatitis C to approximately 2,000 people.

In May 2015, Rivero Mestre filed two class actions against Florida Blue on behalf of people with employer-sponsored plans and non-employer sponsored plans. The lawsuits alleged that Florida Blue was unlawfully rationing a cure by imposing certain coverage requirements on people suffering from hepatitis C, whose livers had not yet developed advanced or severe stages of liver fibrosis. A year later, Rivero Mestre obtained a landmark settlement under which Florida Blue has agreed to remove the contested coverage requirements, paving the way for at least 2,000 people suffering from hepatitis C to now receive a cure to a previously incurable, potentially life-threating disease. The settlement provides at least $126 million dollars’ worth of relief to the settlement class and has far-reaching implications for people suffering from hepatitis C all across the United States.

MIAMI – The Daily Business Review reported on Rivero Mestre’s representation of Carlos Loumiet in his suit against the Office of the Comptroller of the Currency.

A malicious prosecution lawsuit by a DLA Piper partner in Miami against the Office of the Comptroller of the Currency has survived a motion to dismiss.

However, a federal judge in Washington has thrown out part of the suit by Carlos Loumiet against four OCC investigators.

“We are really happy the case is going forward,” said Loumiet’s attorney, Andres Rivero of Rivero Mestre of Coral Gables. “We will, however, preserve our rights for appeal regarding the claims against the individuals. We are proceeding to discovery.”
