MIAMI—The Second Circuit’s thorough and thoughtful opinion in Chevron v. Donziger, ruling against members of the Lago Agrio plaintiffs’ group (“LAPS” in the decision), contains a careful discussion of the evidence of wrongdoing by Steven Donziger and his cohorts. The court’s legal analysis includes discussion of:

  1. standing under Article III;
  2. mootness;
  3. judicial estoppel; and
  4. international comity.

Rivero Mestre participated in a series of U.S. discovery proceedings under 28 U.S.C. § 1782 to collect evidence for the criminal defense of Chevron executives in Ecuador, including the proceedings that obtained the outtakes of a film about the Ecuador litigation—Crude—directed by documentarian Joseph Berlinger. On June 17, 2010, the Ecuadorian court dismissed the criminal charges based on the U.S. discovery materials obtained. Rivero Mestre subsequently participated in the investigation that led to key evidence underlying yesterday’s ruling.

MIAMI — Jorge A. Mestre spoke at the American Bar Association Commercial and Business Litigation Committee’s A Guide to Cross-Border Discovery roundtable on Nov. 13, 2014. The roundtable offered practical tips for navigating the process of obtaining discovery abroad for cases litigated in the United States and for dealing with discovery issued from foreign venues.

The Commercial and Business Litigation Committee focuses on issues facing litigators with broad commercial practices, including substantive areas such as bankruptcy, creditor rights, professional liability, and trade secret law, and procedural matters such as e-discovery, privilege, ADR, and international litigation.

Mestre’s practice is focused on commercial litigation, including international arbitration and litigation.

Rivero Mestre represented the chief in-house counsel for “TexPet,” a subsidiary of Chevron Corporation. Rodrigo Pérez Pallares was the victim of bogus criminal charges brought by the Government of Ecuador, which was working in collusion with plaintiffs’ lawyers attempting to extort a multi-billion dollar settlement from Chevron for claims of environmental damage dating back to 1990 when TexPet ceased its Ecuadorian operations.

In 2010, Rivero Mestre commenced a series of U.S. discovery proceedings under 28 U.S.C. § 1782 to collect evidence for Pérez Pallares’ criminal defense in Ecuador. Most importantly, it sought and obtained the outtakes of a film about the Ecuador litigation—Crude, directed by documentarian Joseph Berlinger, best known for Paradise Lost: The Child Murders at Robin Hood Hills. On June 17, 2010, the Ecuadorian court dismissed the criminal charges based on the U.S. discovery materials.

MIAMI – On October 3, 2011, Jorge A. Mestre was a guest lecturer at the University of Miami School of Business Administration, Business Law Department. He lectured at the Business Law Department’s class on International Business Law. The course is designed to acquaint business students with the general framework of the international legal system, the manager’s role in it, and the specific institutions and practices that affect international business. Mestre’s presentation included a discussion about cross-border litigation, issues of venue, jurisdiction, service of process, and international arbitration.

Mestre’s practice is focused exclusively on commercial litigation, including international arbitration and litigation. Mestre is also an adjunct professor at St. Thomas University School of Law, where he teaches international arbitration.
